These Terms of Service ("Terms") govern your access to and use of the Interceptis website at interceptis.com (the "Site") and the Interceptis platform and services (the "Services") provided by Interceptis, Inc. ("Interceptis," "we," "us," or "our"). By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree, do not use our Site or Services.
Our Services are designed for use by law enforcement agencies, public safety organizations, and other governmental entities. By using our Services, you represent that you are authorized to enter into these Terms on behalf of the agency or organization you represent and that your use complies with all applicable laws and regulations.
You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to attempt to gain unauthorized access to any part of the Services, interfere with the proper functioning of the Services, or use the Services to store or transmit malicious code.
Access to the Interceptis platform is provided on a subscription basis as set forth in the applicable Order Form or Service Agreement between Interceptis and your agency. Fees are due as specified in the Order Form. We reserve the right to modify pricing with 90 days written notice prior to the start of a renewal term.
The Services, including all software, content, designs, and documentation, are owned by Interceptis and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services during the subscription term solely for your internal operational purposes. You may not copy, modify, distribute, sell, or lease any part of our Services.
You retain all rights, title, and interest in and to the data you enter into the Services ("Agency Data"). Interceptis does not claim ownership of Agency Data. We process Agency Data solely to provide the Services as described in the applicable Data Processing Agreement. Upon termination of your subscription, we will make your Agency Data available for export for a period of 90 days.
Interceptis maintains security controls designed to meet CJIS Security Policy requirements and other applicable standards. Security measures include encryption, access controls, audit logging, and continuous monitoring. Detailed security specifications are provided in our Security Documentation and Data Processing Agreement.
To the maximum extent permitted by law, Interceptis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill. Our total aggregate liability shall not exceed the amounts paid by you to Interceptis during the twelve months preceding the claim.
You agree to indemnify and hold Interceptis harmless from any claims, damages, losses, or expenses arising from your use of the Services in violation of these Terms, your violation of any law or third-party rights, or any Agency Data processed through the Services.
Either party may terminate the subscription as set forth in the applicable Service Agreement. We may suspend access to the Services immediately if we believe your use violates these Terms or poses a security risk. Upon termination, your right to access the Services ceases, and we will handle Agency Data as described in the Data Processing Agreement.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the federal or state courts located in Arlington County, Virginia.
We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms on our Site with a revised "Last updated" date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
